Welcome to HeartSong (“HeartSong,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, services, products, digital content, and any related offerings (collectively, the “Services”). By accessing or using HeartSong, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Nature of the Service
HeartSong provides custom, personalized musical creations, including but not limited to songs, audio recordings, lyrics, and related digital content, created based on information you voluntarily submit. All HeartSong creations are artistic and expressive works, intended for personal enjoyment, gifting, encouragement, inspiration, and memorial or celebratory purposes.


HeartSong does not provide:

  • Medical advice

  • Mental health counseling

  • Legal advice

  • Professional therapy

  • Emergency services


If you are experiencing emotional distress or crisis, please seek professional or emergency assistance.

 

2. Eligibility
You must be at least 18 years old or have permission from a legal guardian to use HeartSong. By using our Services, you represent that you have the legal capacity to enter into this agreement.

 

3. User Submissions
When you submit names, stories, messages, photos, or other information (“User Content”), you confirm that:

  • You have the legal right to submit the content

  • The content does not violate any law, copyright, trademark, or privacy rights

  • The content does not contain hate speech, abuse, or illegal material

 

You grant HeartSong a limited, non-exclusive license to use your submitted content solely for the purpose of creating your requested product and delivering the Service. We do not claim ownership of your personal story.

 

4. Personalized & Custom Work – No Refund Policy
Because HeartSong delivers custom-made, personalized digital products, ALL SALES ARE FINAL once production has begun. Refunds, chargebacks, or cancellations are not available, except where required by law.

 

By purchasing, you acknowledge and agree that:

  • Personalized work cannot be resold or reused

  • Minor artistic interpretation differences do not constitute defects

  • Creative style and vocal performance are subjective

 

5. Delivery & Turnaround
Delivery timelines are estimates, not guarantees. Factors such as workload, holidays, revisions, or technical issues may affect timing.


HeartSong is not liable for delays outside of reasonable control.

 

6. Revisions

Revisions may be offered at our discretion and are limited to:

  • Minor lyrical adjustments

  • Small factual corrections

 

Revisions do not include full rewrites, stylistic overhauls, or new creative directions unless otherwise stated in your package.

 

7. Intellectual Property

All HeartSong compositions, melodies, recordings, arrangements, and production elements are the intellectual property of HeartSong, unless otherwise stated in writing.

You receive a personal-use license to:

  • Play

  • Share privately

  • Gift

​

You may not:

  • Resell

  • Distribute commercially

  • Claim authorship

  • Upload to streaming platforms for profit without written permission from HeartSong.

 

8. Optional Public Use Permission

If you grant permission (such as via a checkbox, form, or written consent), you allow HeartSong to use excerpts of your song or testimonial for:

  • Website display

  • Promotional materials

  • Social media

  • Advertising

 

You may revoke this permission in writing for future use.

 

9. Disclaimers

HeartSong is provided “AS IS” and “AS AVAILABLE”.

 

We make no guarantees regarding:

  • Emotional outcomes

  • Personal impact

  • Spiritual results

  • Listener interpretation

 

Faith-based expressions are offered as encouragement, not doctrine, counseling, or instruction.

 

10. Limitation of Liability

To the maximum extent permitted by law, HeartSong shall not be liable for:

  • Emotional distress

  • Loss of data

  • Indirect or consequential damages

  • Misuse of content by third parties

Our total liability shall not exceed the amount paid for the specific Service.

 

11. Indemnification

You agree to indemnify and hold harmless HeartSong from any claims, damages, or legal fees arising from:

  • Your submitted content

  • Your misuse of the Services

  • Violation of these Terms

 

12. Termination

We reserve the right to refuse service, suspend access, or cancel orders if:

  • These Terms are violated

  • Submitted content is unlawful or abusive

  • Fraud or misuse is suspected

 

13. Governing Law

These Terms are governed by the laws of the United States and the State in which HeartSong operates, without regard to conflict-of-law principles.

 

14. Changes to These Terms

We may update these Terms at any time. Continued use of HeartSong after changes constitutes acceptance of the revised Terms.
